PJC Demands that Maryland Comply with Federal Medicaid Regulations

On October 29, 2004, the Public Justice Center sent a strongly worded letter to Secretary McCann of DHMH requesting that the Department, after two years of no action, take immediate action to bring more than six dozen Maryland regulations into compliance with federal law. In Jackson, v. Millstone, the Court of Appeals ruled in June 2002 that these regulations violated federal law, and the Department has done nothing about it since. The out-of-compliance regulations permit the Department to deny medical care to children based on the illegal criterion of "appropriateness."
