Legislative Alert: Support Workers' Rights to Overtime Payment

CALL YOUR LEGISLATORS NOW! TELL THEM TO SUPPORT WORKERS' RIGHTS TO OVERTIME PAYMENT BY VOTING IN FAVOR OF HB 214 AND SB 694.

THE ISSUE: Maryland law allows for treble damages to those who are illegally denied their full wages under Maryland’s Wage Payment and Collection Law. This is good policy: the threat of treble damages encourages compliance by deterring scofflaw employers, and it ensures that those unlawfully denied the pay they have earned have adequate legal recourse.

The problem is that some federal courts have interpreted Maryland law to say that workers cannot recover damages for wage claims that involve overtime. This current state of judicial chaos hurts low-wage workers most – without the potential for damages that include overtime, their claims are not large enough to file in federal court and they often cannot find legal counsel to help them file in state court.

THE SOLUTION: HB 214/SB 694 simply clarify Maryland law by adding “overtime” to the list of examples of wages under Maryland’s Wage Payment and Collection Law, so that that workers illegally denied overtime have adequate remedies available to them.

WHAT YOU NEED TO DO: This bill may be in trouble because of a last minute maneuver by the Maryland Chamber of Commerce, which had the vote before the full house postponed so they could spend the next few days lobbying hard against it. We need you to make calls to members of the House of Delegates now. The bill was originally heard by the House Economic Matters Committee, so calls to those committee members are also appreciated, but we need the support of as many Delegates as possible.
