News Flash: Victory in Thompson Case

Judge Barry G. Williams in Thompson et al v. Donald issued ruling from the bench this morning. He found that the Department of Human Resources has engaged in a pattern and practice of violating federal and state laws by failing to decide eligibility on applications for food stamps, Medicaid and other benefits within 30 days. The Judge held that the law is clear that 100% compliance is required, and that the state's financial and practical problems are not a legal defense. He issued a permanent injunction requiring DHR to comply with the law. The state must submit a plan within 45 days to achieve full compliance within 12 months.
